Flat Roof Repair in NJ: What the Written Contract Must Say

In New Jersey, a home improvement contract for more than $500 has to be in writing and signed. It must name the work, the main materials, the total price, the start and finish dates and any warranty. For a flat roof repair, that means the contract should say which membrane you have and exactly what gets fixed.

Flat roofs usually leak at a seam, a wall edge or a drain, and a contract that only says "repair flat roof" does not tell you which one you are paying for. Four Seasons Roofing and Construction handles flat roof repair across North Jersey from 38 Speer Ave in Clifton. This guide goes through the state's home improvement rule, N.J.A.C. 13:45A-16.2, and turns each required item into something you can check on a flat roof estimate. We read the rule on October 26, 2026.

Does a flat roof repair need a written contract in New Jersey?

Yes, once the price passes $500. Under the rule, all home improvement contracts for a purchase price in excess of $500, and all changes to their terms, have to be in writing, signed by all parties, in legible form and understandable language.

It applies to any structure used in whole or in substantial part as a home, one unit or several, so the flat roof over the back addition of a two-family counts. So does a leak repaired at night: the definition of home improvement includes work done under emergency conditions.

What does the contract have to list?

Section 16.2(a)12 names six items, and here they are next to what each one means on a flat roof.

What the rule requiresOn a flat roof repair
The seller's legal name and business address, plus the name and address of the sales representative who negotiated the contractThe company's legal name and street address on the page, and the name of the person who sold you the job.
The work to be done and the principal products and materials, including type, grade, quality, size or quantityThe membrane named (EPDM rubber, TPO or modified bitumen), the spot being repaired (a seam, wall flashing, a pipe boot, a drain or scuppers) and the repair material.
The total price, including all finance charges. On a time-and-materials job, the hourly labor rate and any other terms that affect priceOne number for the repair. If it is billed by the hour, the hourly rate in writing.
The dates or time period for starting and finishing the workA start date and a finish date. Some flat roof products need warmth to cure, so ask whether a winter repair gets a temporary seal now and a finishing pass in spring, and put both visits on the dates line.
A description of any mortgage or security interest taken in connection with financingIf the job is financed and the lender takes a security interest in the property, the contract has to describe it.
A statement of any guarantee or warranty on products, materials, labor or servicesWhat the repair is guaranteed against and for how long, in words you can read back.

Warranties have to be specific, clear and definite and list any exclusions or limits, and you get a written copy with the bid and again at signing. A manufacturer's own warranty can wait until installation.

How do you name the membrane in the contract?

Our flat roof repair page lists the three membranes we repair: EPDM rubber, TPO and modified bitumen, the layered asphalt rolls often called torch-down. A repair has to match what is already on the roof, because a glued patch on a heat-welded TPO roof is likely to leak again.

Not sure what you have? Ask the roofer to write it down after walking the roof and to photograph it. Our guide to standing water on a flat roof explains how to tell ponding from normal drainage, which is worth settling alongside any seam repair.

What happens if the roofer finds more damage?

Once the roofer opens up a flat roof repair, the job can change. Water runs sideways along a flat deck, so a leak at one seam can leave wet insulation under the membrane. Any change to the terms has to be in writing, dates included, and if the job grows the new scope should arrive on paper with a price and a date before the extra work starts.

A delay outside the seller's control also calls for timely written notice, with the new start or finish date. Our flat roof page says a seam repair on a sound membrane is the economical end and widespread membrane failure usually means a conversation about replacement, with photos of what was found. For that choice, see should you repair or replace your roof.

Who pulls the permit, and when is the final payment due?

A seller may not start work until it is sure that all state or local building permits required for the job have been issued. If midpoint or final inspections are required, you get the inspection certificates when the work is done and before the final payment is due, and nobody can ask you to sign a certificate of completion or pay the final bill before the work is finished under the contract.

Whether a flat roof repair needs a permit at all depends on the building. For a detached one- or two-family house, the state lists repair or replacement of the existing roof covering as ordinary maintenance, with no permit. For an attached home or a building with more units, ask the town. Our guide to permits for emergency roof repair shows where that state list stops.

What does a Four Seasons flat roof estimate include?

We inspect the roof first and photograph what we find, and the estimate comes in writing, itemized, before any work starts. On a flat roof the visit begins by tracing the leak to its source, since the stain only shows where the water ended up, and we look for the failed seam or flashing first. One customer described the estimate this way in a Google review:

“…provided a written estimate and verbally explained what was needed and how they would make my roof repairs.…”
